Big Splash Photo Contest Rules & Regulations

HOW TO ENTER:
No purchase necessary. The contest begins on June 30, 2011 and ends on September 5, 2011 (the "Contest Period"). All entries must be received by September 5, 2011 ("Submission Deadline"). To enter, visit www.bingemans.com/photocontest to upload your digital file. Photos will only be accepted by uploading the image to www.bingemans.com/photocontest/. No CD, prints or negatives will be accepted. Entrant can enter unlimited entries.

DETAILS:
Entries will be rejected if the entry form is not fully completed and entry form or Photo is not received by the Submission Deadline.
Digital files should be at least 5 megapixels; image quality setting: high; file must be under 2MB. Colour correction and tonal cast changes are acceptable; compositional changes, as well as added watermarks or signatures, will result in automatic disqualification. Digital entries that do not meet technical requirements will be automatically rejected.

ELIGIBILITY: Contest is open to legal residents of Canada and the U.S., except employees (and those with whom such employees are domiciled) or agents of Bingemans or Jackson Marketing Corp., and the contest judges. Entrants 13 years of age or younger must have consent from their parent or legal guardian to enter this Contest. In the event it is discovered that you entered without consent from your parent or legal guardian, all entries will be void

SUBMISSION REQUIREMENTS:
You must have taken the Photo that you submit for the contest. You will require the consent of all individuals who are included in the Photo. The submitted Photo must never have been previously published, exhibited publicly, or selected as a winner in any other contest and only amateur photographers are eligible (defined as a person who has never earned more than $1,000 in any year for photography). All Photos submitted become the property of Bingemans. Entries not complying with these contest rules will be disqualified.

Prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at Bingemans’ option. Winners will be required to pick up their prizes from the 425 Bingemans Centre Drive, Kitchener, ON N2B 3X7. If the winner is a minor in his/her province, territory, or state of residence, such winner’s parent or legal guardian must accept the prize on his/her behalf.

WINNER SELECTION:
A panel of judges appointed by Bingemans and Jackson Marketing Corp. consisting of staff will judge all Photos submitted on the basis of originality, creativity, technical proficiency, and uniqueness appropriateness.
All judging criteria will be weighed equally. In the event of a tie, the Photo with the highest score in creativity will be selected as the winner. Photos which are illegal, defamatory, or in any way obscene, all as determined solely by Bingemans, will be disqualified. Judging will be completed and the winners contacted by September 9, 2011. If you have not been contacted by this date, you may assume that your entry is not a winner.
Odds of a Photo being selected by the contest judges as the winner of the Grand Prize depend on the number and calibre of entries received. By accepting a prize, winner agrees that their Photo becomes the property of Bingemans and will not be returned. Winner grants Bingemans the right in perpetuity to publish and use winner’s Photo, as is or as may be edited in Bingemans sole discretion, accompanied by winner’s full name and city of residence in any advertising and promotion by Bingemans without further compensation, including but not limited to the 2011 Big Brochure and Bingemans website. Selected winners agree to assign all intellectual property rights including copyright, and waive all moral rights in and to the Photo in favour of Bingemans.

GENERAL CONDITIONS:
No correspondence will be entered into except with the selected winners. This contest is subject to all applicable federal, provincial, and municipal laws. Void where prohibited by law. The decisions of the contest judges with respect to all aspects of this contest are final and binding on all entrants without right of appeal.
Selected winners (or winner’s parent or legal guardian if a minor) will be required to sign and return a standard Declaration, Liability and Publicity Release, releasing Bingemans, Jackson Marketing Corp., and the contest judges, from any and all liability arising directly or indirectly from this contest, participation in contest related activities, the awarding of a prize, and the use or misuse of any prize. By entering the contest selected winners agree to comply with these official contest rules and agree to the publication, reproduction, and/or other use of his/her name, address, statements about the contest, and/or personal photograph or other likeness without further compensation, in any publicity or advertisement carried out by Bingemans in any manner whatsoever, including print, broadcast, or the Internet. Bingemans, its advertising and promotion agencies, and the contest judges are not responsible for late, lost, misdirected, postage-due, delayed, or illegible entries. Without limitation, Bingemans, its advertising and promotion agencies, and the contest judges will not be liable for the failure of any entry or Photo to be received.
Bingemans reserves the right to withdraw or amend this contest in any way, in the event of an error, technical problem, tampering, unauthorized intervention, fraud, technical failure, or any other cause beyond the reasonable control of Bingemans that interferes with the proper conduct of this contest as contemplated by these Rules. Any attempt to deliberately undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, the Bingemans reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Bingemans, reserves the right to cancel or suspend this contest in the event of any accident, printing, administrative, or other error of any kind without prior notice or obligation.
By entering this contest, each entrant expressly consents to Bingemans, its agents and/or representatives, storing, sharing, and using the personal information submitted with his/her entry only for the purpose of administering the contest and in accordance with Bingemans Privacy Policy found at www.bingemans.com unless the entrant otherwise agrees.
